2003 News Releases "FOR IMMEDIATE RELEASE" MOSAID Adds Two New Patents to its Claims Against Samsung and Infineon OTTAWA, Ontario, Canada – November 3, 2003 – MOSAID Technologies Incorporated (TSX:MSD) today announced that it has now filed an amended counterclaim in the litigation with Infineon Technologies and an amended complaint in the litigation against Samsung Electronics. On September 15, 2003, the U.S. Judicial Panel on Multidistrict Litigation consolidated the two litigation cases in New Jersey for coordinated pretrial proceedings. The U.S. District Court for the District of New Jersey has now permitted amendments which allow MOSAID to add two new patents to its claims in the actions against both Infineon and Samsung – Foss Patent No. 6,580,654, issued June 17, 2003, and Lines Patent 6,603,703, issued August 5, 2003. The joint claims construction hearing – known as the Markman hearing – remains scheduled for January 27 and 28, 2004. "The U.S. Patent Office granted these new patents after considering allegations of prior invention documented by Samsung during the current litigation," said George Cwynar, President and CEO for MOSAID. "We therefore believe the addition of these two new patents will strengthen our ongoing cases against both Samsung and Infineon," said Cwynar. The ten patents at issue in the litigation were granted to MOSAID based on its fundamental Dynamic Random Access Memory (DRAM) circuit inventions. MOSAID has developed nine generations of DRAM, from 4K to 256M, during its 27-year history. During this time, MOSAID invented key circuit techniques that have been widely adopted by the DRAM industry. At the end of the first quarter of fiscal 2004, MOSAID's portfolio contained 512 issued or pending patents. Since 1999, MOSAID has signed comprehensive patent licensing agreements with nine companies: Fujitsu, NEC, Toshiba, Hitachi, Mitsubishi Electric, OKI Electric, Matsushita, Sony and most recently, Winbond. MOSAID believes that all companies which manufacture mainstream DRAM products, including single and double data rate (DDR) synchronous DRAM, as well as Rambus® DRAM, use its patented circuit technology.
